Live Poker Regulation in Italy: the Role of Police Chiefs

The debate on live poker regulation in Italy is complex. Its facets touch law, sociology and sports policy. To understand the origins of the problem it is fundamental to analyze the report “Sport discipline and the game of poker” by Prof. Crismani. This document played a fundamental role in the development of the Skill Poker Index.

A Patchwork Regulation

In Italy live poker regulation is in the hands of Police Chiefs. They decide on the authorization of gaming activities, based on their perception of the balance between luck and skill. The result is a disjointed situation across the country. Some regions allow the game, albeit with restrictions. Others prohibit it completely [Crismani, 2008]. This regulatory fragmentation penalizes players and organizers. It makes it impossible to build a coherent national sports system. And it confirms how urgent an objective and universal solution is.

The Authorization Dilemma

Crismani describes in detail the process of gaming authorization. The central issue is the difficulty in determining whether winning or losing is predominantly random or not [Crismani, 2008]. The problem is structural. A game that is normally not based on chance can become so if modified in a way that makes luck the dominant element. This ambiguity leaves ample room for subjective interpretation by Police Chiefs. And that subjectivity is exactly what generates territorial disuniformity.

The Debate in the Sector

The issue was addressed during the first edition of “The Future of Gaming in Italy”, an online conference organized by SBC Events in collaboration with gioconews.it. Industry experts discussed the challenges and opportunities for live poker regulation. The need for a balanced solution emerged clearly. A solution that takes into account the needs of players, operators and competent authorities.

Why the Skill Poker Index Are the Answer

Territorial disuniformity and the subjectivity of authorizations stem from a single problem: the absence of an objective tool. A universal criterion that measures the degree of skill involved in a live poker game. The Skill Poker Index were developed precisely to respond to this need. They provide decision-making authorities with a deterministic and measurable reference. They remove discretion from Police Chiefs. And they open the way to the sporting recognition of the discipline.
